Terms of Service

These Terms of Service ("Terms") govern the contractual relationship between ParallelSignal GmbH, Marktgasse 8, 4051 Basel, Switzerland ("we", "us") and you ("Customer") when purchasing digital audit reports, marketing services, or other digital products through our website.

By placing an order, you confirm that you have read and agree to these Terms.

We offer the following services:

• AI Visibility Audit Reports: Digital reports analyzing your brand's visibility across AI platforms, search engines, and digital channels
• Performance Marketing Consulting: Strategic advisory and campaign management services
• Custom Digital Marketing Services: As separately agreed in writing

The specific scope of each service is described on our website at the time of purchase or in a separate service agreement.

• Orders are placed through our website and processed as one-time payments via Stripe. We do not offer subscription-based billing unless separately agreed.
• All prices are displayed in the applicable currency at checkout and include any applicable taxes.
• Payment is due at the time of order. The contract is formed upon successful payment confirmation.
• We accept major credit cards, debit cards, and other payment methods as offered by Stripe at checkout.

• Digital audit reports are delivered via email to the address provided during checkout within 24 – 48 hours of payment.
• Consulting services are scheduled separately after payment confirmation.
• If we are unable to deliver within the stated timeframe, we will notify you by email with an updated delivery estimate.

Given the digital nature of our products:

• Before delivery: You may request a full refund within 14 days of purchase if the report has not yet been delivered.
• After delivery: No refunds are available once the digital report has been delivered to your email, as the product cannot be "returned." This is consistent with the exception for digital content under Swiss consumer protection law.
• Defective delivery: If the delivered report contains material errors or does not match the service description, we will correct it at no additional cost or issue a refund at our discretion.

To request a refund, contact info@parallelsignal.ch with your order reference.

• All audit reports and deliverables remain the intellectual property of ParallelSignal GmbH until full payment is received.
• Upon payment, you receive a non-exclusive, non-transferable license to use the delivered report for your internal business purposes.
• You may not resell, redistribute, publicly publish, or create derivative works from our reports without our prior written consent.
• Our brand, website content, methodologies, and tools remain our exclusive property.

To the maximum extent permitted by Swiss law (Art. 97 ff. OR, Obligationenrecht):

• Our reports and recommendations are provided for informational and advisory purposes. They do not constitute guarantees of specific business outcomes.
• We are not liable for indirect, incidental, or consequential damages arising from the use of our services or reports.
• Our total liability for any claim arising from an order shall not exceed the amount paid by the Customer for that specific order.
• Nothing in these Terms excludes liability for intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit) as required by Swiss law.

We treat all information provided by you (brand details, competitor information, business data) as confidential. We will not share your business information with third parties except as necessary to deliver the agreed services, or as required by law.

We process your personal data in accordance with our Privacy Policy and the Swiss Federal Act on Data Protection (FADP / nDSG).

We reserve the right to update these Terms. Changes take effect upon publication on this page. Existing orders are governed by the Terms in effect at the time of purchase.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

These Terms are governed by the laws of Switzerland.

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Basel-Stadt, Switzerland, unless mandatory legal provisions dictate otherwise.
